Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the Cali D’Cuisine website (the “Site”) and any services, registrations, bookings, events, classes, donations, purchases, content, or communications made available through the Site (collectively, the “Services”). The Site and Services are operated by Cali D’Cuisine, Inc. (“Cali D’Cuisine,” “we,” “us,” or “our”).

By using the Site or Services, you agree to these Terms. If you do not agree, do not use the Site.

 

1) Who We Are / What We Offer

​

Cali D’Cuisine provides culinary-related offerings including (as available from time to time) custom catering, culinary classes/workshops/experiences, events, and community programs and fundraising/donations.

 

2) Eligibility

​

You must be at least 18 years old to purchase Services, register, or donate unless a parent/legal guardian completes the transaction on behalf of a minor and accepts these Terms.

​

3) Changes to the Site or Terms

​

We may update the Site, Services, pricing, and these Terms at any time. Changes are effective when posted. Continued use means you accept the updated Terms.

​

4) Accounts, Forms, and Accuracy

​

If you submit a form, request a quote, register, donate, or make a purchase, you agree that the information you provide is accurate and complete. You are responsible for any activity that occurs through your account (if applicable).

5) Quotes, Bookings, and Confirmations

​

Submitting an inquiry or request does not guarantee availability or acceptance. A booking/registration is confirmed only when we provide confirmation (and when applicable, receive payment/deposit).

​

6) Catering and Custom Services (Separate Contract Controls)

​

Catering and custom on-site services are governed by a separate written catering/service agreement signed by you and Cali D’Cuisine. That agreement will address deposits, payment schedules, cancellations, headcounts, venue requirements, staffing, rentals, and other event-specific terms.

​

If there is any conflict between these Terms and a signed catering/service agreement, the signed agreement controls for that service.

​

7) Food Allergies and Dietary Restrictions

​

You are responsible for notifying us in writing and in advance of any allergies or dietary restrictions relevant to your service or event. While we take reasonable precautions, we cannot guarantee an allergen-free environment.

​

8) Classes, Workshops, Experiences (Assumption of Risk)

​

Cooking and culinary activities involve inherent risks (including burns, cuts, slips/falls, and allergic reactions). By participating, you agree to follow safety instructions and assume these risks to the fullest extent permitted by law (except to the extent caused by our gross negligence or willful misconduct).

9) Payments
 

Prices, taxes, and fees (if any) will be shown at checkout or in a written proposal/confirmation. Payments may be processed through Wix and its integrated payment providers. We do not intentionally store complete payment card details on our own systems.

 

10) Refunds

Your purchase may be subject to our Refund Policy, plus any specific terms shown at checkout/registration.

  • Donations are non-refundable (except where required by law).

  • Catering/custom services follow the signed catering/service agreement.

 

11) Donations and Recurring Charges

If you make a recurring donation or subscription-type payment, you authorize us (and our payment processors) to charge your payment method at the selected frequency until you cancel via the available method or by contacting us (where applicable).

 

12) Shipping

​

We do not currently sell or ship physical products through the Site.

​

13) Intellectual Property

​

All Site content (text, images, graphics, logos, designs, videos, course materials, downloads, and brand assets) is owned by or licensed to Cali D’Cuisine and protected by intellectual property laws. You may use the Site for personal, non-commercial purposes only. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.

14) User Submissions (If You Provide Content)

​

If you submit content to us (e.g., testimonials, reviews, photos, or feedback), you grant Cali D’Cuisine a non-exclusive, worldwide, royalty-free license to use it for business purposes (including marketing), subject to your rights under applicable law and our Privacy Policy. You represent you have the rights to share that content.

 

15) Prohibited Uses

 

You agree not to:

  • misuse the Site (hacking, scraping, malware, interference),

  • violate laws or third-party rights,

  • attempt to gain unauthorized access to any systems or data.

 

16) Third-Party Links and Services

 

The Site may contain links to third-party sites or tools. We are not responsible for third-party content, policies, or practices.

 

17) Privacy, Cookies, and Analytics (No Ads)

 

Our collection and use of personal information is described in our Privacy Policy. We use cookies and plan to use third-party analytics to understand Site usage and improve performance. We do not currently run paid advertising campaigns.

 

18) Disclaimers

The Site and Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Site will be uninterrupted, error-free, or secure.

19) Limitation of Liability

​

To the fullest extent permitted by law, Cali D’Cuisine will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill arising out of or related to your use of the Site or Services.

​

To the fullest extent permitted by law, our total liability for any claim will not exceed the amount you paid to us for the applicable Service in the 12 months before the event giving rise to the claim (or $100 if no payment was made).

​

20) Indemnification

​

You agree to defend, indemnify, and hold harmless Cali D’Cuisine and its directors, officers, employees, contractors, and agents from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site/Services or violation of these Terms.

 

21) Governing Law and Venue

​

These Terms are governed by the laws of the State of California (without regard to conflict-of-law rules). Any dispute will be brought in state or federal courts located in San Diego County, California, and you consent to jurisdiction and venue there.

​

22) Severability and Waiver

​

If any provision of these Terms is unenforceable, the rest remain in effect. Our failure to enforce any right is not a waiver.
